gpn11 STATE OF GEORGIA COUNTY OF RABUN NOTICE OF SALE UNDER POWER Because of a default in the payment of the indebtedness secured by a Security Deed executed by James O. Sheffield and Patricia G. Sheffield to Mortgage Electronic Registration Systems, Inc. as nominee for AME Financial Corporation dated August 15, 2008, and recorded in Deed Book D34, Page 275, Rabun County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. by Assignment, securing a Note in the original principal amount of $102,400.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, August 5, 2014, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land lying and being in Land Lot 20 of the 5th District, Rabun County, Georgia, said tract containing 1.14 acre as shown on that plat of survey prepared by A.B. Turnbull, G.R.L.S., No. 1557, dated July 28, 1978, said plat being recorded in Plat Book 17, page 38, Rabun County, Georgia Records, and further described in that plat of survey dated May 14, 1999 prepared by William F. Rolader, G.R.L.S. No. 2042, as recorded in Plat Book 42, page 247, which plats are incorporated herein and made a part hereof by this reference. Also conveyed is the right to use that certain 40 foot road right-of-way located on the northeasterly boundary of the above described property and shown on the herein referenced plat of survey, which provides for access for ingress and egress from said property to Shirley Mill Road. The herein property is subject to the rights of others to use said portion of the above described property contained within the boundaries of a 40 foot wide road right-of-way shown upon the herein referenced plat. Said reservation is contained in the Warranty Deed dated 10/25/1991 as recorded in Deed Book J13, page 106, Rabun County, Georgia Records. The property is also subject to that certain Easement and Road Maintenance Agreement dated February 28, 2005 as recorded in U27, page 37, aforesaid records. Said property is known as 136 Gentry Lane, Tiger, GA 30576, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
