Under and by virtue of the Power of Sale contained in that certain Deed to Secure Debt given by Lake Burton Development, LLC (the “Grantor”) to Cadence Bank, N.A. ("Lender") dated November 9, 2007 and recorded November 15, 2007 in Deed Book X-32, Page 355, Rabun County, Georgia official records (together with any and all additional amendments and modifications, collectively hereinafter referred to as the “Security Deed”), conveying the property described below to secure repayment of: (i) that certain Commercial Fixed Rate Promissory Note given by Grantor to Lender dated November 20, 2008 in the stated principal amount of $1,097,328.00, together with interest thereon as set forth therein; (ii) that certain Commercial Variable Rate Promissory Note given by Grantor to Lender dated November 18, 2008 in the stated principal amount of $200,768.00, together with interest thereon as set forth therein; and (iii) any and all other indebtedness, plus interest thereon, due and owing by Grantor to Lender, whether now existing or hereinafter created (together with any and all prior notes, amendments or modifications, collectively hereinafter referred to as the “Secured Indebtedness”), there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Rabun County, Georgia, within the legal hours of sale on the first Tuesday in November 2011 (being November 1, 2011) the following described parcel of real property together with all improvements, personalty, fixtures, easements, hereditaments, rights, members, and appurtenances located thereon and described in the Security Deed: All that tract or parcel of land lying and being in Land Lot 24 of the Fourth Land District of Rabun County, Georgia, and being designated as Lot 4 containing 0.25 acres, Lot 5 containing 0.24 acres, Lot 6 containing 0.24 acres, Lot 11 containing 0.15 acres, Lot 12 containing 0.17 acres, Lot 17 containing 0.21 acres, Lot 21 containing 0.35 acres, Lot 23 containing 0.31 acres, Lot 30 containing 0.40 acres and Lot 32 containing 0.45 acres of The Timbers of Kingwood Estates as shown on that certain plat of survey prepared by Wayne A. Said plat and the record thereof are hereby incorporated herein and made a part hereof by reference. The property herein conveyed is subject to that Declaration of Covenants, Conditions and Restrictions for The Timbers at Kingwood recorded in Deed Book 0-25, Page 638, Clerk's office, Rabun Superior Court, and all modifications and amendments of record thereto. Conveyed herewith is a perpetual, non-exclusive easement for the use, maintenance and repair of water and sewer lines which traverse adjacent property owned by Kingwood, LLC which serve the above referenced tract of land. NOTICE OF SALE UNDER POWER

Because of default in the payment of the indebtedness, secured by a Security Deed executed by Christina N. Justus and Gregory B. Justus and W Bruce Justus to Mortgage Electronic Registration Systems, Inc. as nominee for Crescent Bank and Trust Company, its successors and assigns dated May 11, 2001 in the amount of $247,200.00, and recorded in Deed Book W-20, Page 27, Rabun County, Georgia Records; as last transferred to JPMorgan Chase Bank, National Association by assignment; the undersigned, JPMorgan Chase Bank, National Association pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in November, 2011 , during the legal hours of sale, at the Courthouse door in Rabun County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit: All that tract or parcel of land lying and being in Land Lot 20 of the 1st Land District of Rabun County, Georgia and being Tract No. 1 consisting of 6.01 acres of land more fully described and delineated on a plat of survey prepared by Tommy J. Phillips, Georgia Registered Land Surveyor # 1626 and dated September 18, 1996, revised May 3, 2001, being recorded in the Rabun County, Georgia deed records in Plat Book 46, Page 99 and reference is had and made to said plat and record of same for a more full and complete description of said lands. Being a portion of the lands received by Bruce Justus in a deed from Mrs. Rufus B. English recorded in said deed records in Deed Book E-3 on Page 212 in Deed From Rufus English, Jr. and Margaret Sue English Bradshaw recorded in said deed records in Deed Book S-5, Page 413-414, which has the property address of 667 Rainbow Creek Rd, Clayton, Georgia, together with all fixtures and other personal property conveyed by said deed. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
