Pursuant to the Writ of Fieri Facias entered by the Superior Court of Rabun County, Georgia on November 5, 2025, Civil Action No. 2025SUCV722CJ and in favor of Melba Wells Trehern, individually, and as surviving child of Melba Wells Trehern, deceased, and as representative of the wrongful death beneficiaries of Melba Wells Trehern, and as Personal Representative of the Estate of Melba Wells Trehern, deceased, Plaintiffs and against Traces of Tiger, Inc., Charles R.
Pennington, and John/Jane Doe 1-10. Defendants, the below described property will be sold at public auction to the highest and best bidder for cash, between the legal hours of sale before the courthouse doors in Rabun County, Georgia on the first Tuesday in July, 2026 to wit: July 7, 2026. A certain tract or parcel of land in Rabun County, in the Starte of Georgia, described as follows: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 37 OF THE FIFTH LAND DISTRICT OF RABUN COUNTY, GEORGIA,, LOCATED AT THE INTERSECTION OF BRIDGE CREEK ROAD AND CLEVELAND ROAD CONTAINING 4.51 ACRES, ALL ACCORDING TO THE PLATOF SURVEY THEREOF DATED "REVISED" MARCH 1, 1990, BY T. LAMAR EDWARDS, GEORGIA REGISTERED LAND SURVEYOR, NO. 1837, A COPY OF WHICH PLAT IS RECORDED IN PLAT BOOK 28, PAGE 194 RABUN COUNTY RECORDS. SAID SURVEY IS INCORPORATED HEREIN BY REFERENCE FOR A FULL AND COMPLETE DESCRIPT OF THE ABOVE-DESCRIBED LANDS. THE ABOVE-DESCRIBED PROPERTY IS A PORTION OF THE PROPERTY CONVEYED TO THE GRANTORS BY ED L. ROANE BY DEED DATED NOVEMBER 5, 1983, A COPY OF WHICH DEED IS RECORDED IN DEED BOOK X-8, PAGES 560-561, RABUN COUNTY RECORDS.
Said property having been found to be in the possession of the defendant Traces of Tiger Inc. and levied upon as the property of the defendants in accordance with the Writ of fieri Facias stated above. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record, which may affect said property. The sale will be conducted subject to confirmation that the sale is not prohibited under the United Staes Bankruptcy Code.
